Habitability Inspection and Documentation
For attorneys, landlords, property managers, and multifamily investors across Los Angeles County and Orange County. I document building conditions against California habitability standards in a form built for evidentiary use, underwriting review, and code enforcement.
Request a habitability documentation reportIf you have received a tenant demand letter, a code enforcement notice, or you are preparing for litigation, contact me before you respond. Early documentation is often the most important evidence in the file.
A report is not useful because it has photos. It is useful because it documents conditions, dates, locations, measurements, and applicable standards, and it states the limits of what I am opining on, in a form that can be defended later. That is the difference between a record that protects you and a stack of pictures that does not.
I read code, not just checklists. My work is grounded in code enforcement fluency, multifamily compliance depth across RHHP, SCEP, SB-721 and the related programs, and the kind of documentation discipline that holds up under scrutiny. The same inspector works with the landlord, the property manager, the investor, and the attorney, on either side of a matter. For rental owners, this is often called an implied warranty of habitability inspection, because it documents whether the property meets the legal standard that the warranty requires. If you want the legal background first, start with my explainer on the implied warranty of habitability in California.
Who I work with
Most inspectors write for one audience. The people who actually need habitability documentation fall into four groups, and the report is built for each.
Landlords and owners
Document conditions before a complaint becomes a claim. If a tenant has sent a demand letter, get a factual record of actual conditions before you respond, and before you call your insurer. A landlord habitability inspection captures a rental property's condition against the standards that matter when disputes arise.
Property managers and portfolios
Portfolio-wide habitability exposure review across your buildings, unit by unit, using one consistent standard and one report format so you can compare and prioritize. Especially valuable for apartment habitability inspection across multiple units under one management.
Attorneys, either side
Independent documentation, built for evidentiary use, for tenant-side or landlord-side matters, with deposition and trial testimony on my findings. Available as a habitability expert witness for matters that reach litigation.
Multifamily investors
Pre-acquisition documentation on habitability exposure, deferred conditions, and unpermitted work, scoped to what buyers, lenders, and capital partners need to see in the file.
Services
Each engagement is scoped to what the situation needs, from a single unit to a full portfolio.
Habitability Documentation Report
The core service. A point-in-time record of a unit or building measured against California habitability standards, for any rental in LA County or Orange County.
Litigation-Grade Habitability Inspection
Attorney-retained, tenant-side or landlord-side. Built for evidentiary use, with an evidentiary documentation report prepared to be defended in deposition and at trial.
Habitability Expert Witness Testimony
For matters that reach litigation. Independent habitability expert witness engagements including standards-based rebuttal to opposing reports, deposition testimony, and trial testimony on my findings. Engagements run on a retainer, with deposition and testimony rates set out in my fee schedule and case-specific engagement letter.
Demand-Letter Response Documentation
You received a tenant demand letter citing habitability violations. I document the actual conditions, so you and your attorney are building a demand letter response on facts, not assumptions.
Pre-Renewal and Pre-Litigation Condition Audit
A risk-focused and insurance-focused snapshot of condition before a policy renewal, a sale, or an anticipated dispute, so there are no surprises in the record. For multifamily buyers who need a full property condition assessment as part of pre-acquisition due diligence, see also my multifamily due diligence service.
Multi-Unit Habitability Walk-Through
Portfolio review on a per-unit basis, the right fit for owners and managers who want documented exposure across multiple buildings.
If your property sits in a specific enforcement program, I also handle RHHP prep and SCEP response and SB-721 and SB-326 balcony inspections. Those are applications of the same documentation discipline, with habitability as the larger picture.
What is in the report, and why it is built to hold up
The evidentiary value is in the structure, not the volume of photos. Every California habitability report includes:
- Dated, location-tagged photographs of each documented condition
- Measurements where the severity of a condition depends on them
- References to the applicable standard: Civil Code 1941.1, Health and Safety Code 17920.3, Title 25, and the habitability standards courts apply
- Plain condition narratives that describe what was observed, where, and when
- Clearly stated limits of opinion, so the report says exactly what it does and does not establish
Scheduling and turnaround
I can typically schedule within the same week, and most reports are delivered the next day after the site visit. Litigation engagements run on the timeline set in the engagement letter. For urgent matters involving hearing, insurance, or filing deadlines, I accommodate expedited scheduling.
Scope and limits
I document observable conditions against California habitability standards. I am not an attorney and do not provide legal advice. I do not provide construction-defect opinions, structural engineering analysis, or electrical code interpretation. Where those are needed, I document what I observe and recommend the appropriate licensed professional, for example, a structural engineer for balcony or seismic questions. I am available for the tenant side or the landlord side, and being clear about these limits is part of what makes the documentation credible.

Frequently asked questions
Do you work for tenants or landlords?
Both. I document conditions against California habitability standards, and the findings are the findings either way.
Will your report hold up in court?
No one can promise what a court will do. What I control is how the report is built: dated and location-tagged photographs, measurements, code references, plain condition narratives, and clearly stated limits of opinion. I am available for deposition and trial testimony on my findings.
How is this different from an RHHP or SCEP inspection?
RHHP and SCEP are government enforcement programs in specific jurisdictions. A habitability documentation report is independent, applies to any rental in California, and is built to be defensible rather than to satisfy a single program checklist.
Can you document conditions after a tenant has already sent a demand letter?
Yes. Documenting actual conditions after a demand letter arrives, before you respond, is one of the most common reasons owners and their attorneys call.
How long is a habitability inspection report valid?
A habitability documentation report doesn't carry a formal expiration date, but it reflects the property condition on the inspection date. Most owners refresh documentation annually or before a policy renewal, a sale, or an anticipated dispute to keep the file current.
Can I share this documentation with my insurance carrier or my attorney?
Yes. The report is your record. Owners commonly use it to support insurance claims, demonstrate proactive maintenance in habitability disputes, or give attorneys a dated baseline when responding to tenant complaints, notices, or demand letters.
As a landlord, does a tenant have to let me into the unit for habitability documentation?
Under California Civil Code §1954, landlords can enter for necessary repairs and inspections with at least 24 hours' written notice. Most tenants cooperate when the visit is framed as proactive maintenance rather than a formal inspection.
If the RHHP inspector still finds issues after my prep, does prior documentation help?
Yes. Even when the county identifies items your prep didn't catch, prior documentation demonstrates good-faith maintenance effort. It also gives you a baseline to track corrections cleanly within the 21-day window the county allows.
Do you give legal advice?
No. I document conditions against California habitability standards, and I work regularly with attorneys and property counsel who need that documentation for their cases. For legal questions about your specific situation, talk to an attorney.
